Policy Council Luncheon & Roundtable (Afternoon Workshop E)

If there is one thing all cannabis business owners know, it is that compliance with state regulations is a time-consuming and challenging task. But in the not-too-distant future, it is likely that there will be federal regulations layered on top of those state regulations. This luncheon and roundtable is dedicated to exploring that future and discussing how we can take a proactive approach to shaping those regulations.
To that end, the National Cannabis Industry Association recently launched the NCIA Policy Council, a committee that supports the development of cannabis industry-related policy at the federal level. During this roundtable, Policy Council staff will provide participants with an update on the current federal policy landscape, as well as an overview of the Policy Council’s work, including the Council’s first white paper, which is expected to be released around the time of the Cannabis Business Summit.
Following this overview, there will be a great panel, featuring two experts in cannabis regulations, an expert in alcohol regulations, and the president of the American Herbal Products Association. They will discuss, based on the federal government’s experience with these other two products, how cannabis is likely to be regulated at the federal level — and, if there is a difference, how it should be regulated.
Roundtable participants will then have the opportunity to contribute directly to the Council's future work by sharing their own thoughts about potential federal policy priorities. After breaking out into smaller discussion groups, participants will report what each group collectively considers to be the five most critical issues for industry operators. The full list of policy priorities will be presented to the Policy Council following the conference.
All interested in shaping federal cannabis policy are welcome to attend this luncheon and roundtable - individuals need not be current cannabis industry operators to participate in this workshop as experience in other industries or fields will only enhance the overall level of insight in the room.
Afternoon Workshop B1:00 pm - 4:00 pm Terroir Potential: Encourage Producers to Consider Genetics and the Environment in Pursuit of Chemotype (Read More) The challenge of delivering cannabis with predictable chemical characteristics and specific medical or recreational effects is at the cutting edge of the burgeoning industry. The plant chemotype that delivers these chemical characteristics is not a fixed character of a particular cannabis strain. Rather it is a trait that is influenced by the interaction between genetics and environment. In other industries, most notably the wine industry, these interactions between genetics and environment as reflected in the quality and characteristics of the harvested product are described by the term terroir. In cannabis production, where the environment is controlled, the exciting prospect exists to determine and create the terroir and the resulting vernacular related to the medical and sensory outcomes. This workshop will explore the potential to exploit the interaction between genetics and the environment with an emphasis on the contribution that horticultural media (soil) water & nutrients bring the environment. This pre-summit workshkop is designed to promote an exchange of ideas between the lead presenters and attendees. The presenters bring a deep experience of soil, molecular and evolutionary biology, and plant biochemistry and genetics. The presenters have all applied their experience within the industry and this session will present this knowledge at the cutting edge of cannabis production. The workshop will delve into the interaction between plant genetics and their expression in a particular growing environment which influences the plant chemotype. For the last decade, entrepreneurs have been operating in a gray area, with limited guidance under the California Compassionate Use Act, the Medical Marijuana Program Act, and the August 2008 California Attorney General?s Guidelines for the Security and Non-Diversion of Marijuana Grown for Medical Use. You'll find some have been formed and operating as nonprofit mutual benefit corporations, nonprofit public benefit corporations, general business corporations, and some that have not incorporated at all. This is a roadmap for how to the business can position itself to apply for a license under MCRSA (and in compliance with local law under the dual licensing system) and operate on a for-profit basis. Since passage of MCRSA, the first thing clients ask is how they can be ready for when state license applications are available. Given the wide variety of business organizations we've seen, we hope to lay out the process for these operators to be application-ready (even though we do not yet know the application process itself). This quagmire of intersecting legal regimes has been an impediment to tribes seeking to regulate cannabis and launch business ventures. The Wilkinson memorandum of 2014, for example, suggested that the Department of Justice would treat tribes analogously to states vis--vis marijuana enforcement priorities. However, in practice, tribes have not received similar treatment. This panel seeks to apprise attendees of the complex legal and jurisdictional issues that tribes, and cannabis entities working with tribes, must be aware of when launching cannabis business ventures. The panel will also identify successful scenarios for tribal engagement, as well as pathways for making cannabis regulation in Indian Country a reality. Cannabis criminalization has been identified as a key driver of the mass incarceration epidemic. Marijuana arrests account for over half of all drug arrests in the United States, and black men (and increasingly women) and Latinos are policed, arrested, and convicted of drug-related offenses at over ten times the rate of whites, despite similar rates of drug use across race. This creates an interesting dynamic for the industry and all who have interest in the sustainability of this movement. Considering the increasing need for legitimacy and effective problem solving in regulatory, patient/consumer and community interactions, having a diverse set of minds to tackle these issues is a logical strategy. Also, because of the history of the war on drugs, many minority communities do not look towards the burgeoning industry to meet their cannabis needs, rather to the illicit market. Colorado and Oregon businesses are in the midst of fighting a strong illegal market, and this is likely a problem other states will face for years to come. Finally, if cannabis is to be a better industry, not just another industry, we have an obligation to include these communities who have statistically been targeted through prohibition of the plant in ways that provide meaningful benefit. The recent ordinance passed by Denver City Council directs the City?s Environmental Health Department to regulate odors from marijuana growing operations. Other communities in Washington and Oregon are racing to pass similar regulations. This presentation begins with a review of the nature of odors associated with cannabis growing operations. Two odor control technologies (vapor and misting systems) are discussed with application to medium and large scale cannabis growing operations. The odor problem is especially difficult to control at outdoor growing operations due to the fugitive nature of such odors. To meet these challenges, advanced models are employed to assess how odors migrate from a cannabis growing area to nearby homes. This information is used to design a site and facility specific odor control system. Impacts on plant growth and public safety to exposure from odor neutralizers are discussed.
